PURCHASE CONDITIONS

You can place and manage your orders through this website: www.helioferretti.com.

By using this website, you are bound by these conditions, so we recommend that you read them carefully. If you do not agree with them, you must leave the website immediately.

By placing an order, you guarantee that you are over 18 years of age and that you have a store, establishment or another type of business where you can distribute our products. Helio Ferretti is only a distributor of its products and never markets directly with the final consumer. 

Once the purchase process has been carried out and successfully concluded, the customer will receive a confirmation e-mail where the order number and the summary of their purchase will appear. 

We reserve the right to cancel at any time those orders that we consider fraudulent, false or speculative, as well as those that have been requested by a client with whom there may be any difference or controversy in previous orders, or when there are suspicions that may be violating any of the specified purchase conditions.

Helio Ferretti may update these purchase conditions, as well as the legal notice at any time. 


USER OBLIGATIONS

As a user, you are obliged to communicate to Helio Ferretti all the data necessary for access and correct use of the services of this website. The data provided must be true and must be up to date. As a user, you agree that we can use your data in the event that it is necessary to contact you regarding any aspect of the management of your order or another matter that we consider of the utmost importance.

It is absolutely necessary that you provide us with all the information classified as mandatory. If this is not the case, we will not be able to correctly manage your order. In no case, we are responsible for possible delays or failures in delivery as a result of the error or omission of some of the data. 

The user must make proper use of the services included in the website, always in accordance with the legal system and will not carry out any activity that hinders or interferes with its operation.


CONDITIONS ON ORDERS

If you are placing your first order on our website, you will need to register by creating an account in order to access the full catalog and all the content on the website. You can do it from the section:  Create an Account.

In the case of a registered user with an active account, you must enter your e-mail and password to access all the content and be able to manage your orders.

The prices of the items are indicated in euros (€) and do not include VAT. In all the articles of sample the unit price and the price of the total of the set. The sets are inseparable and cannot be modified, except in exceptional situations and always on explicit request. The request in no case guarantees the acceptance of the proposal. In the tab for each item, you can check the units included in each reference and the way they are stocked (models, colors, sizes, designs...).

Shipping cost is a complementary expense that is subject to the area where the merchandise must be delivered and the total amount of the order. You can check the details whenever you need them in the Shipping Conditions section


AVAILABILITY OF ARTICLES

All items are subject to availability. We are not responsible for the lack of existence or the unavailability of the products. In the event that your order includes a reference that is not available at that time, we will notify you as soon as possible via email or telephone and offer you a solution. If you have any questions, you can always contact us. 

If during the preparation of your order, there is any reference that cannot be served at that time due to lack of stock, we will proceed to solve it immediately. If it is an article that is pending arrival, either we will wait until we have all the references to proceed with the shipment, or at your request and our acceptance, we will make the first shipment with all the references that we have and, more late, second shipping as soon as we have the reference or references that were missing in the first shipping. 

If, on the other hand, it is a reference that has definitely sold out and the order has been paid in advance (by debit or credit card or proforma), we will proceed to issue a payment so that the amount of the missing item can be deducted in the next order and we will inform you immediately. 


PLACEMENT OF ORDERS

Once you have completed the online purchase process, you will receive an order confirmation email. You can pay for your order by debit or credit card or by proforma invoice. If you have agreed with us to another method of payment other than those mentioned above, you must select the option Usual payment method

If it is your first order, you can only pay by debit or credit card or by proforma. To request a different payment method for the following orders, you must contact us. 

In case of making the payment by proforma, keep in mind that the document that is sent automatically at the end of the order is not the proforma invoice, it is simply a summary of the order. 

Once you have received the original proforma invoice (once the order has been reviewed and validated), you can proceed to make the transfer. We will provide you with the bank details at the same time we send the proforma. Incoming orders that have been paid by credit card or with your usual payment method, after being validated and authorized, go to the warehouse where they will be prepared in 24-48 hours (except for times of intense activity, such as Christmas, reception of new collections or Fairs, in which the preparation time may be delayed).

In case of payment by proforma, the order is not authorized until we receive the payment (it can take between 24 and 48 hours depending on the conditions of the issuing and receiving bank). If you want to speed up this process, you can send us proof of payment of the transfer once it has been made so that we can authorize the order and start preparing it as soon as possible. 

Once the order is prepared, it is delivered to transport to proceed to its distribution. At the time the order is delivered to the transport company, Helio Ferretti is not responsible for the delivery time, since it may be delayed depending on the delivery point and for other reasons beyond our control. 


ORDER CONFIRMATION AND CANCELLATION

Before finalizing the web order, you can review all the details of each item (price, batch units, assortment...) being able to correct what you consider appropriate at any time. 

Once the order has been completed and confirmed, it cannot be canceled through the website or by any other means. If you need a modification of any of its aspects, please contact us as soon as possible. Depending on the state in which the order is found, we do not guarantee that we will be able to fulfill your request. Once the order has started to be prepared in our warehouses, no modifications are allowed. 


CURRENCY, TAXES AND PRICES

In accordance with current legislation, all purchases from our website will be subject to value-added tax, with the exception of the Canary Islands, Ceuta, Melilla and foreign countries. The applicable rate will be the one legally in force at any given time. 

Orders destined for the Canary Islands, Ceuta and Melilla are exempt from Spanish VAT, but the customer must bear the taxes and expenses of entry and exit of the product in their Community (IGIC, customs clearance, etc.). These expenses must be paid directly by the customer to the logistics operator in charge of delivering the merchandise. In the same way, the client must bear the cost of the producer leaving his community (customs clearance) when the order is returned.

All prices are shown in euros (€) and correspond to the gross amount of the item. If it is necessary to add VAT to your order, you will see it reflected during the order completion process. Transport costs (if applicable) as well as taxes and duties for the entry and exit of the product in the Canary Islands, Ceuta and Melilla will never be included in the price of the items. 


METHOD OF PAYMENT AND SECURITY

If you want to place your first order, it can only be paid by debit or credit card or by proforma invoice. To request a different payment method for the following orders, you must contact us. 

If you select payment by proforma, we will send you the proforma along with our bank details to the email associated with your account as soon as we review the order. Please note that if you choose this payment method, we will not start preparing your order until we receive the payment in our account. If you want us to prepare your order immediately, you can send us the proof of payment after completing the transfer so that we can begin to process it and thus be able to send it as soon as possible. 

If you are a regular customer and have been assigned a payment method that is not one of those mentioned above, you will have the option to finalize your order with the payment method that you have agreed with us. In that case, the website will give you the option to select the Usual Payment Method before finalizing your web order. 

Remember that the data of your debit or credit card will not be saved or manipulated in any file of our property. These data are only managed by the payment gateway of the corresponding financial institution. All transactions managed through the Helio Ferretti website are carried out through the SSL (Secure Socket Laver) protocol of the Redsys server of La Caixa in order to guarantee the confidentiality and integrity of all transactions. 

In case of selecting payment by debit or credit card and that, for any reason, you cannot complete the payment at that time, you must take into account that the order will be given "not completed" and, therefore, will be automatically canceled. You can send it again after a few minutes or if you think it may be a technical issue, please contact us right away. 


ORDER DELIVERIES

The delivery of your order will be made to the address provided by you at the time of registration. In case you want to send your package to an address other than your billing address, you must indicate it in the Delivery Data section in the second step of the order completion. 

In normal circumstances, we prepare your shipment during the first 24-48 hours after receiving the order. In the event that the order has been paid by pro forma, the package is prepared within 24-48 hours after receipt of payment (not from the date of placing the order). 

These deadlines could be delayed in periods of high activity such as Fairs, reception of new collections, or Christmas campaigns.

Incoming orders after 1:00 p.m. on Friday will be processed from Monday first thing in the morning. 

Your order will be delivered to transport the same day it is finished preparing. Once the package is in the hands of the logistics company, the time elapsed until you receive it will depend on the transport company. Helio Ferretti is not responsible for the delivery time, since it may be delayed depending on the distance from the delivery address or for reasons beyond our control, such as the weather, the volume of shipments, strikes, customs procedures...

For shipments to the Canary Islands, Ceuta and Melilla, our warehouse delivers the merchandise to transport as soon as the package is ready. Transportation ships all the merchandise collected every Friday (only one shipment per week). Once the merchandise is shipped, the delivery time will be different depending on the location of the destination address, the marine weather conditions, or other reasons specific to the logistics operator in charge of the delivery. At the time of receipt of the order, the customer must pay the taxes and duties derived from the entry and exit of the product in the aforementioned territories. However, these deliveries are considered exempt from VAT. 

The usual delivery time will be approximately between 3 and 7 business days after the approval of the order. This term may increase during sales periods, Christmas campaigns, or in case of customs procedures or other circumstances derived from a geographical distance, weather, strikes, any form of government intervention, etc. as well as any other attributable to the logistics operator in charge of delivering the merchandise. We are not responsible for possible delays that may arise for any of these reasons. 


SHIPPING

Shipping costs will be free for the customer and will be assumed by the company as long as the amount of the gross order exceeds the amount indicated in the   Shipping Conditions. In case you have to pay the postage, these may also vary depending on the area where the delivery is made or the type of transport you choose. You can consult the   Shipping Conditions whenever you need them. In the process of finalizing the order, you will be able to choose between two transport options. In the event that the order includes articles made of glass, ceramics, or other fragile materials susceptible to breakage, the shipment will only be possible through one of the logistics companies, in order to ensure that the products reach their destination in perfect condition. In that case, the system will not offer you the option to choose a transport company.
